END USER LICENSE AGREEMENT (EULA)

STANDARD EULA

The Hypnothera mobile application ("Licensed Application") is licensed, not sold, to you. Your license to the Licensed Application is subject to your prior acceptance of Apple's Licensed Application End User License Agreement ("Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

The Standard EULA is granted by Apple and defines the basic terms of use, including license scope, data usage, warranties, and liability limitations. Please read the Standard EULA carefully as it forms the primary agreement governing your use of the Licensed Application.

SUPPLEMENTARY TERMS

In addition to the Standard EULA, the following supplementary terms ("Supplementary Terms") apply to your use of the Licensed Application. These Supplementary Terms are between you and El Sueno LLC ("Company", "we", "us", "our") and provide additional app-specific terms and important disclaimers.

1. NATURE OF THE LICENSED APPLICATION

1.1. NOT A MEDICAL DEVICE: The Licensed Application is a general wellness and self-improvement product. It is NOT a medical device and is NOT intended for the diagnosis, treatment, mitigation, or cure of any disease or medical condition.

1.2. General Wellness Purpose: The Licensed Application is designed exclusively for: a) Stress management and relaxation b) Personal development and self-improvement goals c) Enhanced focus and productivity d) Building confidence and positive habits e) General mental well-being and daily life enhancement

1.3. AI Content Generation - Not Care Delivery: The artificial intelligence used in the Licensed Application functions exclusively as a content generation tool: a) It generates personalized scripts based on user-provided, non-clinical self-improvement goals b) It does NOT diagnose, assess, monitor, or provide treatment for any medical or psychological condition c) It does NOT engage in care delivery functions or clinical decision-making d) All available categories are limited to general wellness topics only

1.4. FDA Compliance: The FDA has stated that recordings claiming to be effective as hypnotherapy for the "mitigation, treatment or cure of a specific disease or medical condition" may be regarded as medical devices. The Licensed Application explicitly does NOT make such claims. All content is intended exclusively for general wellness, self-improvement, and personal development purposes.

2. MEDICAL AND SAFETY DISCLAIMER

2.1. The Licensed Application is for entertainment, educational, and general wellness purposes only. We explicitly state that:

a) We do not provide medical services, therapy, or professional healthcare of any kind b) The Licensed Application is not intended to be a substitute for professional medical advice, diagnosis, or treatment c) Always seek the advice of your physician or qualified health provider regarding any medical condition d) Never disregard professional medical advice because of something you have accessed through the Licensed Application

2.2. If you have been diagnosed with any medical or psychiatric condition (including but not limited to Clinical Depression, Generalized Anxiety Disorder, Post-Traumatic Stress Disorder, Specific Phobias, Panic Disorder, or any sleep disorder), you must consult with a licensed healthcare professional before using this Licensed Application.

2.3. You acknowledge that entering a state of hypnosis or deep relaxation carries inherent risks, including:

Temporary disorientation
Unexpected emotional responses
Emergence of suppressed memories
Physical responses such as drowsiness

2.4. You are solely responsible for:

Ensuring you are in a safe environment before using hypnosis audio
Not operating vehicles or machinery while listening to our content
Immediately discontinuing use if you experience adverse effects
Consulting healthcare professionals about the appropriateness of hypnosis for your condition

3. USER ELIGIBILITY

3.1. You must be at least 18 years old to use the Licensed Application.

3.2. By using the Licensed Application, you represent and warrant that you are of legal age to form a binding contract.

3.3. Content Policy: No subscription tier, including the Ultimate tier, permits illegal or non-consensual content. Regardless of any "unrestricted," "no moderation," or "complete creative freedom" language used to describe a tier, you may not create content involving minors or underage individuals, rape or sexual assault, non-consensual or coerced sexual acts, incest, or bestiality. These prohibitions apply to every tier without exception. See Section 5.5 of our Terms of Service for the full Adult Content Policy.

4. SUBSCRIPTION AND PAYMENTS

4.1. Certain features of the Licensed Application require payment and/or subscription ("Premium Features").

4.2. All purchases and subscriptions are: a) Billed to your Apple ID account b) Auto-renewable unless cancelled at least 24 hours before the end of the current period c) Billed for renewal within 24 hours prior to the end of the current period d) Manageable through your Apple ID account settings

4.3. Prices and availability of Premium Features are subject to change without notice.

5. PRIVACY AND DATA COLLECTION

5.1. Our collection and use of personal information in connection with the Licensed Application is governed by our Privacy Policy, which is available at https://hypnothera.ai/privacy.

6. GOVERNING LAW

6.1. These Supplementary Terms shall be governed by the laws of the State of Arizona, without regard to its conflict of law provisions. This is in addition to the governing law provisions in the Standard EULA.
